In March 2015, the Court of Appeal gave a Judgment that has huge implications for customers who have entered into a loan agreement, introduced by a credit broker. Essentially, should a customer go through a credit broker to arrange a secured loan, then the consumer is entitled to the “single minded loyalty” of the credit broker. This means that they must act in good faith, not place themselves in a position where their interests may be conflicted, and, most importantly, must not take a secret profit or commission.
